Terms of Service

SampleSnap (samplesnap.com, "the Service") is operated by Craft Cloud, a company registered in England and Wales [REVIEW: legal form, company number and registered address] ("we", "us"). By creating an account, uploading, buying or downloading, you agree to these terms. If you do not agree, do not use the Service.

We sell every product on the Service as the merchant of record. Your contract for a purchase is with us, and the creator licenses their work to you through us under the licence shown on the product.

We may update these terms. Material changes are announced on the site or by email at least 14 days before they take effect. Continuing to use the Service after that date means you accept the new terms.

You must be at least 18, or the age of majority where you live, to sell on the Service. Buyers must be at least 16.

You are responsible for everything done through your account and for keeping your sign-in details private. Tell us straight away if you believe your account has been accessed without your permission.

One person, one account. We may close accounts that are shared, sold or used to evade a suspension.

Prices are shown in US dollars and include any VAT or sales tax that applies to you. Your card issuer may convert the charge to your own currency at its own rate.

Payment is taken by Stripe. We never see your full card details.

A paid product is delivered as a digital download as soon as payment succeeds. Because of that, at checkout you ask us to deliver immediately and acknowledge that you lose your 14-day right to cancel once the download starts. Before you download, you may cancel for a full refund by contacting us.

• If a file is corrupt, materially different from its description or cannot be downloaded, tell us within 30 days and we will fix it or refund you.
• We do not refund because a sound did not suit a project, or because you changed your mind after downloading.
• Refunds go back to the original payment method. A refunded purchase ends your licence to the product and you must delete your copies.

Every product carries one of three licences chosen by its creator: Royalty free, Credit required or Non-commercial. The full text of each is on the licences page and is part of these terms. The licence that applied at the time of purchase stays with your purchase even if the creator later changes it.

Free products are licensed on the same terms as paid ones.

No licence allows you to resell, share or redistribute the files themselves, in whole or in part, including inside another sample pack or preset bundle, or to use them to train or fine-tune a machine learning model.

By uploading you confirm that you own or control every right in the audio, that it contains no uncleared samples, loops or stems belonging to anyone else, and that you have the right to grant the licence you selected.

You grant us a worldwide, non-exclusive licence to host, process, preview, watermark, promote and sell your products on the Service, and to keep delivering them to people who bought them even after you remove a product or close your account.

You keep the copyright in your work. We do not claim ownership of anything you upload.

• Prices are set by you within the limits shown in the dashboard. We take the commission for your plan from what is left after payment processing fees and tax; the rest is yours.
• Earnings are held for 14 days, and 30 days after your first sale, to cover refunds and chargebacks. Available balances are paid every Friday once they reach the payout minimum, and in full when you close your account.
• A refund or chargeback on a sale reverses what that sale earned you. We absorb the processing fees.
• Pro subscriptions renew monthly until cancelled. Cancel at any time from your billing page; you keep Pro until the end of the period you have paid for. The free trial is available once per account.

• Audio you do not have the rights to, including loops from other sample packs, rips of commercial recordings and sounds generated from copyrighted material.
• Products that misrepresent their tempo, key, length or contents.
• Hate speech, harassment, sexual content involving minors, or material that is unlawful where you or we are based.
• Malware, or files that are not audio.

We may remove products, hide comments or ratings, withhold earnings connected to a breach, or suspend accounts, with or without notice, where we reasonably believe these rules have been broken. Repeat infringers are banned.

If you believe content on the Service infringes your rights, email us with the product link, proof of ownership and your contact details. We act on valid notices promptly and will tell the uploader.

Ratings and comments must be your own honest opinion of a product you have listened to. No spam, advertising, abuse or rating your own products. We may remove anything that breaks this and may limit how often you can post.

We work hard to keep the Service running but do not promise it will always be available or error free. We may change or withdraw features, and may suspend the Service for maintenance.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Otherwise, our total liability to you for all claims connected with the Service in any 12-month period is limited to the amount you paid us in that period.

We are not liable for indirect losses such as lost profits, lost projects or lost data, or for the acts of other users.

These terms are governed by the law of England and Wales. Consumers also keep the protection of the mandatory laws of the country they live in. Disputes may be brought in the courts of England and Wales, or in your local courts if you are a consumer.
